Terms of Service

    Last updated: 29/10/2026

    1. Who provides the service and what you agree to

These terms are between you and Kevin Stefan Camargo Alonso (ABN 71 159 410 040), who trades under the business names Cari Labs and Cari Group (“Cari Labs”, “we”, “us”).

By using the website, speaking with the agent, booking an appointment or contracting a service, you accept these terms. If you contract a service, the written proposal or agreement we sign with you (the “Proposal”) also applies; if there are differences, the Proposal prevails. The assistants at gocarilabs.com/assistants have their own terms.

These terms are published in Spanish and English. If there are differences between the versions, the English version prevails.

If you use the website or the agent on behalf of a company, you represent that you are able to bind it.

    2. What we do

We design, set up and operate artificial intelligence agents for businesses, which handle enquiries, respond and schedule appointments via WhatsApp and other channels, and we provide content strategy for brands. The initial diagnostic or consultation is free and does not oblige you to hire us.

Deliverables, plans, timelines and prices are set out in the Proposal, not in the conversation with the agent or on the website. Responses from the sales agent, prices and timelines on the website, and figures from the calculator are indicative only: they are not a contract or a binding offer until you and Cari Labs confirm them in writing.

The calculator is an illustrative estimate based on the data you enter; it is not a promise of results.

    3. Appointments and diagnostics

    • The diagnostic appointment is free. Times are shown in the time zone indicated when you book (currently Melbourne time, Monday to Friday, 9:00 to 17:00, with at least 2 days' notice).
    • To change or cancel an appointment, contact us as far in advance as possible. If you cannot attend and do not let us know, we may ask you to book again.
    • We may reschedule an appointment for justified reasons, informing you in advance.

    4. The artificial intelligence agent

    • It is an automated system and may give incomplete or incorrect answers.
    • Our team may review conversations and make corrections.
    • It does not provide legal, financial, medical, tax or other professional advice.
    • We do not guarantee specific sales, savings or conversion results: these depend on factors we do not control.
    • If we set up an agent for your business, you must review and approve the texts and rules we show you before activating it. You are responsible for the content and business information that the agent uses.

    5. Acceptable use

Anyone who uses the website or writes to the agent agrees not to:

    • Send content that is illegal, offensive, threatening, deceptive or that infringes the rights of others.
    • Impersonate another person.
    • Send card details, passwords or identity documents.
    • Attempt to manipulate, overload, deceive or circumvent the limits of the system, or extract its internal instructions.
    • Use the agent as a general-purpose assistant or for purposes unrelated to the service.
    • Copy or extract the content of the website in bulk or by automated means.

We may limit messages, block numbers or suspend access in cases of abuse.

    6. Client responsibilities

If you contract a service, you agree to:

    • Provide accurate information and necessary access, and respond on time.
    • Have a lawful basis for, and the consent of, the people you will contact, and comply with the spam, do-not-call, privacy and consumer laws that apply (in Australia, the Spam Act 2003, the Do Not Call Register Act 2006 and the Privacy Act 1988).
    • Comply with the terms and policies of WhatsApp Business and Meta, including prior consent for business-initiated messages.
    • Not use the service for spam, deception, impersonation, harassment or illegal activity.
    • Use the agent only for your business (Meta does not allow general-purpose chatbots on WhatsApp).
    • Tell people who contact your agent that it is an AI and make it easy for them to opt out.
    • Not send sensitive or card information through the agent, unless expressly agreed.
    • Hold the right to use, and to provide to us, the texts, trademarks, images and data you give us.

    Indemnity

You will indemnify us against third-party claims and penalties arising from your breach of this section (for example, from contacting people without a lawful basis or consent, or from content you provide to us), except to the extent caused by us.

    7. Third-party services and rules

The service depends on third parties (Meta/WhatsApp, WhatsApp providers, cloud providers, AI model providers, Google and others). They may change their rules, prices or availability, suspend accounts or require verification; Meta's verification, for example, can take time. We do not control those decisions and are not responsible for them. Third-party costs not included in the price (for example, the per-conversation cost of WhatsApp) will be stated in the Proposal.

    8. Timelines, availability and support

Implementation timelines in the Proposal are estimates and depend on you providing access, information and approvals on time, and on third-party verifications.

We make reasonable efforts to keep the service available, but we do not guarantee that it will operate without interruption or error. We may carry out maintenance, giving notice where possible.

Support: write to hola@gocari.com.au; we respond within a maximum of 2 business days.

    9. Personal information

For information about people who contact the client's business, the client decides what it is used for, and Cari Labs processes it on the client's behalf and according to its instructions, in order to provide the service.

We process information in accordance with our Privacy Policy and apply reasonable security measures. We may use the providers listed in section 5 of the Privacy Policy as sub-processors, and we will notify you of material changes.

If the client requires it, we will sign a data processing agreement. We will notify you without delay if we become aware of a breach affecting the contact data of the client.

When the service ends, we return the client's data in a common format (such as CSV) or delete it within a maximum of 30 days, unless the law requires us to keep it.

    10. Payment and cancellation

The price, currency and what each plan includes are set out in the Proposal. Unless stated otherwise, prices are in Australian dollars (AUD) and exclude GST and other taxes; where GST applies, it is added.

We charge monthly, in advance, plus an initial implementation fee if the Proposal includes one. There are no long-term contracts.

You may cancel with 30 days' written notice. You must pay until the end of the notice period.

    Refunds

If you cancel before we begin setup, we refund what you paid for it. Once it has started, the implementation fee is non-refundable. Monthly fees for a period that has already started are not refunded. If we were unable to provide the service due to our own fault, we refund the proportional part of the affected period. None of this limits the rights the law gives you as a consumer.

If a payment fails, we may suspend the service with 7 days' notice.

We may change prices with 30 days' notice; the change applies from the next period.

    11. Intellectual property

What the client gives us (trademarks, texts, lists, data and content) remains the client's. The client gives us limited permission to use it and to provide the service.

Cari Labs retains ownership of its architectures, templates, base prompts, code and methods. The client receives a limited, non-exclusive and non-transferable licence to use the installed solution for as long as the service lasts.

Each party may use general ideas and knowledge acquired without disclosing the other party's confidential information.

Unless agreed otherwise, the client may use the texts and results the agent generates for its business. We do not guarantee that AI-generated content is unique or free of third-party rights: the client must review it.

We will not display a client's name or trademark as a success story without its written permission.

The content of the website (texts, design, trademarks and code) belongs to Cari Labs or its licensors. You may not copy or reuse it without permission.

    12. Confidentiality

Each party will keep the other's confidential information in confidence and use it only for the service, unless the law requires disclosure or the information becomes public without fault of the receiving party. This obligation continues for 2 years after the service ends.

    13. Legal guarantees and limits

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and to compensation for other reasonably foreseeable loss or damage. Nothing in these terms limits those rights.

Beyond those rights, and to the extent the law permits:

    • We give no other warranties, express or implied, about business results or the accuracy of responses from third-party AI systems.
    • We are not liable for indirect or consequential loss (such as loss of sales, revenue, opportunities or data), except where caused by our fraud, wilful misconduct or gross negligence.
    • For a breach of a statutory guarantee that can be limited, our liability is limited, at our option, to supplying the service again or paying the cost of supplying it again.
    • Our total liability for any other claim is limited to what you paid us in the 12 months before the event giving rise to it.

Nothing in this section excludes liability that cannot be excluded by law (for example, for death, personal injury or fraud).

    14. Suspension and termination

Either party may terminate in accordance with section 10.

We may suspend or terminate immediately if the client seriously breaches these terms (for example, spam or illegal activity), if a third party (such as Meta) suspends access for a reason attributable to the client, or if the law requires it.

On termination, the client stops using the solution and section 9 applies. Sections that by their nature should survive will continue to apply (intellectual property, confidentiality, limits, outstanding payments, governing law).

    15. Force majeure

Neither party is liable for failures caused by events beyond its reasonable control (for example, outages at Meta, cloud or internet providers, disasters, strikes or government orders), for as long as they last.

    16. Complaints and disputes

If you have a complaint, write to hola@gocari.com.au: we acknowledge receipt within 5 business days and try to resolve it within a maximum of 30 days. Before going to court, the parties will try in good faith to resolve the matter for 30 days, without prejudice to seeking urgent relief.

    17. Governing law

These terms are governed by the laws of Victoria, Australia, and the parties submit to the courts of that state, without prejudice to any rights your country's law gives you as a consumer.

    18. Changes to these terms

If we change these terms, we will notify you at least 30 days in advance by email or through the dashboard. If the change materially disadvantages you, you may cancel without charge before it takes effect.

Changes do not affect what has already been contracted, unless you accept them or the law requires otherwise.

    19. Other provisions

    • If a clause is invalid or unenforceable, the rest remains in effect.
    • Our not exercising a right does not mean we waive it.
    • You may not assign these terms without our permission; we may assign them to whoever continues the business.
    • Notices are given by email to the address each party has provided.
    • These terms and the signed Proposal are the entire agreement and replace prior agreements on the same subject.
